These Terms and Conditions ("Terms") govern your access to and use of www.elitecollectiverealty.com (the "Website") and any communications, services, or content provided by Elite Collective ("we," "us," or "our"). By using our Website or our services, you agree to these Terms. If you do not agree, do not use the Website or our services.

1. Acceptance of Terms

By accessing, browsing, or using this Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and any other policies referenced herein, including our Privacy Policy. We may modify these Terms at any time, and continued use of the Website constitutes acceptance of the updated Terms.

2. Real Estate Brokerage Disclosure

Elite Collective is a licensed California real estate brokerage operating as Elite Collective Realty LLC. Patricia Blakemore is the Broker/Owner, CalDRE# 02079554. All real estate services are subject to the rules and regulations of the California Department of Real Estate (DRE). Equal Housing Opportunity. 3. No Agency Relationship Without Written Agreement

Use of this Website, submission of an inquiry, or communication with our team does not create an agency, fiduciary, or representation relationship. A formal real estate brokerage relationship is only established by a written, signed agreement (for example, a Buyer Representation Agreement or Listing Agreement).

4. SMS, Voice, and Video Communications

SMS consent is not a condition of any purchase, listing, or service. You may use this Website, request information, and book a strategy call without consenting to text messages.

SMS / Text messages

By checking the SMS consent checkbox on any Elite Collective website form, you expressly authorize Elite Collective to send you recurring text messages at the mobile number provided, including property updates, market intelligence, appointment reminders, listing alerts, and transaction-related communications. The SMS opt-in checkbox is unchecked by default and is not required to submit any form. Message frequency varies — typically 2–8 messages per month. Message and data rates may apply. Voice calls

Providing your phone number on our Website forms authorizes Elite Collective to call you in connection with your inquiry. Providing a phone number without checking the SMS consent box does not authorize marketing text messages.

Video communications

Strategy calls and consultations may be conducted via Zoom, Google Meet, or similar platforms. Participation is voluntary. Elite Collective does not record video calls unless explicit notice is provided and consent is obtained from all participants.

5. IDX / MLS Data

Property data displayed on this Website is provided through California Regional MLS (CRMLS) under an IDX license. Listings are provided for your personal, non-commercial use and may not be reproduced, redistributed, scraped, automated-crawled, or used for any other purpose. Information is deemed reliable but not guaranteed. Listing data is dynamic and may be updated, withdrawn, or modified without notice. Square footage, lot size, school assignments, HOA dues, and tax assessments should be independently verified by the buyer.

6. Intellectual Property

All content on this Website — including the Elite Collective name, EC monogram, logos, photography, copy, market analysis, journal articles, and graphic elements — is the property of Elite Collective Realty LLC and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, republish, or use any content without our prior written consent.

7. No Investment, Legal, or Tax Advice

Information on this Website is provided for general informational purposes only and is not legal, tax, financial, accounting, or investment advice. Always consult qualified professionals — including a California-licensed attorney, CPA, and CFP — before making real estate, tax, or financial decisions.

8. Trust Funds and Escrow

All trust funds, deposits, earnest money, and escrow funds related to a real estate transaction must be delivered directly to a licensed escrow holder — never directly to Patricia Blakemore or Elite Collective Realty LLC personally, and never to any individual agent or representative. Wiring instructions will always be confirmed verbally by phone with a known representative of the escrow company prior to transfer. See Section 16 ("Wire Fraud Warning") for additional protections.

9. Limitation of Liability

To the maximum extent permitted by law, Elite Collective Realty LLC, its members, officers, agents, and employees are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Website or services. Property information is deemed reliable but not guaranteed and should be independently verified. Total aggregate liability shall not exceed the fees actually paid by you to Elite Collective Realty LLC in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Elite Collective Realty LLC, its officers, members, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorney's fees) arising from your misuse of the Website, your violation of these Terms, or your violation of any applicable law or third-party right.

11. Do Not Call Policy

12. Analytics, Cookies, and Session Replay

By using this Website, you agree that we and our service providers may collect and use data about your interaction with the site for analytics, performance measurement, site improvement, fraud prevention, and advertising purposes. We improve our products and advertising by using Microsoft Clarity, Google Analytics, and Google Tag Manager to see how you use our Website. By using our site, you agree that we, Microsoft, and Google may collect and use this data through first- and third-party cookies, behavioral metrics, heatmaps, and session replay technology. 14. Dispute Resolution

Any dispute arising from these Terms or your use of our services shall first be addressed through good-faith mediation. If mediation is unsuccessful within sixty (60) days, disputes shall be resolved in accordance with California law in the state or federal courts located in Los Angeles County, California.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.

16. Wire Fraud Warning

Real estate transactions are a top target for wire fraud and email impersonation scams. Criminals impersonate agents, lenders, title companies, and escrow officers to misdirect closing funds. If you receive an email containing wiring instructions — even from someone you know — DO NOT WIRE FUNDS based on that email alone. Always:
  • Verify wiring instructions verbally, in person or by phone, using a phone number you obtained independently (not from the email).
  • Confirm with both your escrow officer and Patricia Blakemore before authorizing any wire transfer.
  • Be suspicious of any last-minute changes to wiring instructions or urgent demands for immediate transfer.
  • Report suspected fraud immediately to your bank, the FBI's IC3 (ic3.gov), and your local FBI field office.
Elite Collective Realty LLC and Patricia Blakemore disclaim all liability for fraudulent wire transfers initiated based on impersonation, phishing, or email compromise. By using this Website and engaging our services, you acknowledge these risks and agree to follow the verification procedures above.

17. Off-Market & Pocket Listings

Elite Collective may have knowledge of properties that are listed off-market, pre-market, or as private exclusives, including under the terms of the National Association of Realtors Clear Cooperation Policy. Information about such properties is shared at our discretion, may be limited or anonymized, and is provided in confidence. Sharing or republishing off-market property information without our prior written consent is prohibited and may violate seller confidentiality, NAR policy, and applicable state and federal law.

18. Accessibility Statement

19. Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms to the extent caused by events beyond reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, pandemic, government action, war, civil unrest, internet or utility outages, or third-party service failures.

20. Severability & Entire Agreement

If any provision of these Terms is found by a court of competent jurisdiction to be unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and any written brokerage agreement between us, constitute the entire agreement between you and Elite Collective Realty LLC with respect to your use of the Website.

21. Minors

This Website is not directed to children under the age of 13. We do not knowingly collect personal information from minors under 13. If you believe a minor has provided personal information to us, please contact us and we will promptly delete it.

22. Termination

We reserve the right to suspend or terminate your access to the Website, in whole or in part, at any time, with or without notice, for any reason, including violation of these Terms.

23. Notice of Changes to These Terms

We may update these Terms from time to time. The "Effective Date" at the top of this page indicates when these Terms were last revised. For material changes, we may also provide notice by email (to addresses you have provided us), via a banner on the Website, or by other reasonable means. Your continued use of the Website after the Effective Date constitutes acceptance of the updated Terms.
